Terms of Use
These Terms of Use (“Terms”) constitute a legally binding agreement made between the Applicant (“You” “Your” or “Yours”), whether personally or on behalf of an entity (“you”) and Agensi Pekerjaan Liew Mee Choo Sdn. Bhd. (“APLMC”, “we” “our” or “us”), concerning your access or registration to and use of the APLMC services as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the aplmc.com).
You agree that by accessing or registering the aplmc.com, you have read, understood and agree to be bound by all of these Terms of Use. Please read them carefully as they affect Your rights and liabilities under the law. If You do not agree to these Terms, please do not access or register for or use the Agensi Pekerjaan Liew Mee Choo Sdn. Bhd. Services. These Terms are effective as of 31-08-2018. Agreement:
By using this APLMC’s Services, is subject to the use of provided these Terms. This Terms form a binding agreement between you and APLMC. By accessing or using the APLMC Services you agree to accept and/or to be bound by these Terms. you agree to use the APLMC Services at your own risk.
In the case of any conflict between these Terms and any agreement you have with APLMC, these Terms will take precedent.
We maybe update these Terms from time to time for regulatory or legal reasons or to allow the proper operation of the APLMC Services. Notification of any changes will be send to you via email address provided by you on the registration or a suitable announcement on the APLMC website. If you continue to use the APLMC Service after the date on which the change comes into effect, it will be indicates your agreement to be bound with the new Terms. Any change will effectively apply to the use of the APLMC Services after we have given you notice. If you do not wish to accept the new Terms, you should immediately notify us to use the APLMC Service via email at here.
Definitions:
“Client” means any person, firm or company including any associates or subsidiaries to whom you may be introduced.
“Personel Data” means data relating to a living individual (in this case you) that enables them to be identified and includes, but is not limited to, yours name, address, telephone number and email address.
“Services” means the private employment agency services provided by APLMC to you as set out in these Agreement.
“Terms” means is a reference to these Agreement and each of the Schedules as amended or supplemented at the relevant time.
1. The Services
1.1 The services of APLMC shall include selection, pre-employment screening, permit application, processing, documentation, briefing orientation on the working conditions.
1.2 Where any of the registered of your information submitted to APLMC will applicable valid for not more than 12 months of the date of registration.
1.3 Whilst we require its Clients to ensure that all information provided to it is complete, accurate and up-to-date, we do not provide any warranty of guarantee of any kind that the vacancy advertisements and other information made available to you are complete, accurate and up-to-date.
2. Your Information
2.1 You shall provide details which shall include, but not be limited, those regarding their contact information, qualification, training, experience, employment history and accurate necessary information for APLMC to conduct background screening. You acknowledge that all references submitted by you may be contacted, to the best of their knowledge, true, accurate, complete and up-to-date. You shall schedule and appear to all confirmed interviews with potential Clients.
2.2 You accepts and understands that through criminal background screenings and past history verification is essential to be accepted by us.
3. Applications
3.1 When applying for a vacancy, you must ensure that they:
3.1.1 have read the complete details of the vacancy;
3.1.2 understand the requirements of the vacancy;
3.1.3 meet the requirements of the vacancy;
3.1.4 possess any requisite qualifications required by the vacancy; and
3.1.5 have obtained or applied for any relevant permits or authorisations.
3.3 When completing forms or any other application documents, you shall ensure that the details included on the form are to the best of their knowledge, true, accurate, complete and up-to-date.
3.4 We reserves the right and the discretion to decline to forward applications to its Client if it considers them to be in breach of these Terms.
4. Data Protection
4.1 By entering into this Terms, you agree that APLMC may collect, obtain, store and disclose its personal data to the relevant governmental authorities or third parties where required by law or for legal purposes.
4.2 For the avoidance of doubt, Personal Data includes all data defined within the Personal Data Protection Act 2010 including all data the Client, you had disclosed to APLMC.
5. Relationship Between Both Parties
5.1 You understand and agrees that APLMC is not your employer. You and/or the Clients shall define the manner of yours services and provide any equipment necessary. The nature of your or APLMC relationship merely provides a service whereby you might find work with Clients as a source of referrals. You are free to accept or reject any work referred by APLMC.
5.2 Nothing in these Terms shall create, or be deemed to create, a partnership, the relationship of principal and agent, or of employer and employee between APLMC and you.
5.3 You have agreed set forth in agreed by APLMC notification via agreement, email or tele-communication.
6. Confidentiality
6.1 You shall not give their personal information, including but not limited to; phone numbers, email addresses or mailing address to any employing the Client at any time, without written permission from APLMC. You shall contact the Clients THROUGH APLMC ONLY and may only accept additional work requests from Clients, through APLMC.
6.2 At NO TIME may you solicit work form the Clients that are registered with APLMC during the term of this Terms.
6.3 You shall have no further contact with the Client, if they were declined for a position after interview. You agrees they will not call, text or email the Client without written consent from APLMC.
6.4 Pursuant to the Personal Data Protection Act 2010 (“PDPA”), APLMC are mindful and committed to the protection of your personal information and your privacy.
6.5 “Personel Data” refers to any data or information about you from which you can be identified either (a) from that data; or (b) from that data and other information to which APLMC have or are likely to have access. Examples of such Personel Data which you may provide to APLMC include (depending on the nature of Applicant interaction with us):
- Your name, NRIC number,
- Passport number or other identification number,
- Citizenship
- Telephone number(s), Mailing address, Email address
- Academic qualification
- Employment history
- Any other information related to you which have provided to APLMC in any form you have submitted to APLMC, or in other forms of interaction with you.
6.6 APLMC will use the yours personel data to:
- Verify your identity;
- Assist you in search for employment opportunities;
- Process your application including pre-employment screening, employee assessment and checks;
- Assist Client and employers in assessing suitability selection you for employment;
- Other usage related to employment purpose.
6.7 APLMC may disclose your personal data to APLMC’s affiliates or third parties that perform services on APLMC behalf and in doing so APLMC will comply with all applicable laws, regulations and industry standards.
6.8 Notwithstanding anything to the contrary, you may at any time withdraw consent to APLMC processing any personal data to any part or portion of the same by sending to APLMC at the address set out below a written notice of withdrawal and within the period prescribed under the PDPA.

6.9 You hereby agree hold proprietary or confidential information in a strict confidence and not to disclose proprietary or confidential information to third parties or to use such information for any purpose whatsoever other than performing under this Terms.
7. Miscellaneous
7.1 In the occurrence of breach of this Terms by you, you shall fully indemnify APLMC for all costs and expenses, including legal fees and investigation fees, incurred by APLMC in enforcing the terms herein. Further, in the event that APLMC commences proceedings in order to enforce the terms of this Terms, you consents to service of process being made by leaving at yours Address without APLMC having to have regards as to whether you still resides there.
7.2 Each provision of this Terms will be considered severable, such that if any one provision or clause conflicts with existing or future applicable law or may not be given full effect because of such law, no other provision that can operate without the conflicting provision or clause will be affected
7.3 Any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual dispute or claims) in this Terms shall be governed by and construed in accordance with the law of Malaysia.
